RULES OF PARTICIPATION IN 'AVRORA MONEY TREE' LOYALTY PROGRAM

These Rules define the conditions of participation in the Loyalty Program 'Avrora Money Tree', which is taking place in the Sumy region in the network of stores 'Avrora' (hereinafter - 'Venue'), a list of which can be found by calling the Hotline: 067- 872-92-92 or 095-183-12-12. The cost of calls - according to the tariffs of the mobile operator.

1. Terms and definitions

1.1. 'Program' - Avrora Money Tree Loyalty Program, which is a set of actions and activities that allow the Participant to receive and use Bonuses when the Participant purchases goods at the Venue of the Program.

1.2. 'Rules of the Program' -these Rules, which are provided for acquaintance to each Participant by posting on the website of the Program at the link: avrora.ua and which determine the scope of rights and obligations of the Participant when participating in the Program.

1.3. 'Organizer of the Program' - LLC "PRIOR DEVELOPMENT".

1.4. 'Information Center of the Program' - the main means of information support for Participants, namely the Program Site at the link: avrora.ua and telephone numbers of the Hotline: 067-872-92-92 or 095-183-12-12. The cost of calls - according to the tariffs of the mobile operator.

1.5. 'Program Site' is an Internet site located at the link: avrora.ua , through which the information support of the Program Participants is provided and additional services are provided within the Program.

1.6. 'Participant of the Program' / 'Participant' - an individual over 16 (sixteen) years of age who is a consumer within the meaning of the Law of Ukraine 'On Consumer Protection', has unconditionally agreed with the Rules and there are no restrictions on such participation. The rules of the Program are legally binding.

1.7. 'Participant Card' is a bonus card 'Avrora Money Tree', with a unique number within the Program, necessary for identification of the Participant in the Organizer's database.

1.8. 'Bonuses' - conditional units accrued to the Bonus Account of the Participant under the Program in accordance with the Rules of the Program.

1.9. 'Participant Bonus Account' ('Bonus Account", "Account') - a set of information in the Organizer's database about the Participant and his current balance of Bonuses.

1.10. 'Special Offer' - incentives and / or promotional activities that can be used only by Program Participants.

1.11. 'Participant Identification' - a set of measures aimed at identifying a person as a Participant of the Program.

2. Registration of the Participant and activation of the Card

2.1. A person who has expressed a desire to participate in the Program must register by following the link in the form of a matrix encrypted code (QR-code) located at the Venues of the Program: https://t.me/avroraua_bot, viber: // pa? ChatURI = sogodniavrorachat .

2.2. Upon registration, the Participant confirms that he has read and agreed with these Rules of participation in the Program and undertakes to comply with them.

2.3. At registration, the participant must indicate: last name, first name, patronymic, date of birth, place of residence, gender and contact phone number. If necessary, the Organizer has the right to clarify other data of the Participant.

2.4. Each Program Participant can register only one Card in his / her name. Only one Card can be registered for one mobile phone number.

2.5. The Card is activated within 2 (two) working days after the completion of the Participant's registration.

2.6. The Activated Participant Card gives the opportunity to use the Bonuses accumulated on the Participant's Account when purchasing goods at the Venues of the Program. The use of Bonuses means receiving a discount in accordance with the Rules of the Program.

3. Termination of participation in the Program and blocking of the Card

3.1. If the Organizer finds illegal actions of any Participant, including signs of systematic violation of these Rules, the Organizer has the right to exclude the Participant from further participation in the Program without explanation and without any negative consequences for themselves by blocking the Card and Account, cancellation of all accumulated Bonuses. The Organizer reserves the right to determine which actions are a violation of these Rules. Such actions of the Organizer cannot be appealed.

3.2. In case of change of the mobile phone number on which the Card is registered, the Participant must notify the Information Center of the Program and go through the Procedure of Identification of the Participant.

3.3. If the Card is not used by the Participant at the Venues for more than 6 (six) months, the Organizer has the right to block it without notifying the Participant. In case of blocking the Card for this reason, the Participant's participation in the Program is terminated, the Account is blocked, the accrued Bonuses are canceled, the Participant's personal data is destroyed / deleted.

3.4. The Participant has the right to terminate its participation in the Program at any time by contacting the organizer through the Information Centers of the Program to terminate participation, and the Participant must specify the Card number and go through the Participant Identification procedure. Upon receipt of such request by the Organizer, the Participant's participation in the Program is terminated, the Account and the Card are blocked, Bonuses are canceled, the Participant's personal data is destroyed / deleted.

4. Accrual of Bonuses

4.1. To credit Bonuses to the Member's Account when making a purchase and to participate in Special Offers, the Participant is obliged to use his Card at the time of purchase. Any other information carriers (except for the Card barcode from the mobile phone screen and the Aurora Money Tree bonus card) cannot be used to confirm the Participant Card number.

4.2. Bonuses are credited to the Participant's Account by recalculating the total amount of money spent on the purchase of goods (except for the purchase of goods that do not participate in the Program) at the Venues of the Program in accordance with the following proportion:

4.2.1. For 1 (one) UAH spent on the purchase of goods under the Program, there is 1 Bonus.

4.2.2. The Organizer, within the framework of Special Offers and Promotions, has the right to accrue an additional number of Bonuses.

4.2.3. The Organizer has the right to introduce any other additional grounds (proposals) and conditions for accrual or non-accrual of Bonuses, special proposals for Program Participants, by posting information on such grounds (proposals) and conditions in the Venues of the Program and / or advertising and information materials. Organizer.

4.3. Bonuses are credited to the Member's Account within 48 hours from the date of purchase of goods under the Program and / or performance by the Participant of certain actions under the Special Offers and Promotions of the Program, if there are all necessary technical capabilities (there is an Internet connection with the central database of the Organizer).

4.4. Bonuses are accrued for any method of payment (cash or non-cash payment by bank card) available at the Program Venue.

4.5. The document confirming the Organizer's obligation to credit the Bonuses to the Participant's Account is the original cash receipt of the Participant with information about the accrued Bonuses and the Card, which was used when purchasing the goods under the specified cash receipt.

4.6. If the Participant has not accrued the appropriate number of Bonuses when making a purchase using the Card, he has the right to contact the Information Center of the Program and provide information about the cashier's check and the Card with which the purchase was made, in order to check the balance of Bonuses purchase.

4.7. If the Participant does not apply to the Organizer for crediting Bonuses to his Account within 14 days from the date of purchase, the Organizer shall not be liable for crediting Bonuses on the cash receipt of the purchase made using the Card in the absence of Internet connection.

5. Use of Bonuses

5.1. The use of Bonuses at the Venues of the Program is possible in the following case.

5.1.1. If the Card is activated in accordance with the Program Rules.

5.1.2. If there are all the necessary technical possibilities for writing off the Bonuses (there is an Internet connection of the box office in the Venues of the Program with the central database of the Organizer).

5.2. The Program Participant is obliged to notify the Organizer's representative of the desire to purchase the goods using the Bonuses that are accumulated on his Card.

5.3. The participant can write off Bonuses in the amount of all or part of the check, provided that the amount of payment in cash will be at least UAH 0.1 for each unit of goods in the check. In the section of the cashier's check "Deposited" you can check the number of written-off Bonuses for this purchase.

5.4. Bonuses are written off at the rate of 100 Bonus = UAH 1 unless otherwise provided by the terms of the Program.

5.5. The Organizer reserves the right to limit the list of goods, the purchase of which the Participant may use Bonuses.

5.6. When the Participant submits a request to write off the Bonuses from the Card, the representative of the Organizer has the right to require the Participant to present an identity document. Failure to provide an identity document is grounds for denying the Participant the use of Bonuses.

5.7. Bonuses are not a means of payment, have no cash value, do not give the right to receive them in cash and are not refundable.

5.8. The Card and Bonuses accrued on the Participant's Card and the rights granted to him under the Program may not be sold, transferred or assigned to another person or used in any other way, except in the manner prescribed by these Rules.

5.9. The Organizer is not responsible for unauthorized use of the Participant Card.

5.10. Use of Bonuses is possible from the moment of their accrual.

6. Return of goods

6.1. In case of return by the Participant of the purchased goods, the Organizer returns to the Participant the value of the goods, which was actually paid by the Participant in cash, and the number of Bonuses used during the purchase of this goods are returned to the Participant's Account.

6.2. The Organizer has the right to deduct from the Member's Card the appropriate number of Bonuses credited when purchasing the returned goods. If there are not enough Bonuses on the Account for such write-off, the Account balance may become negative.

6.3. The Organizer reserves the right to accrue / write off Bonuses from the Participant's Account in that case and in the amount that was accrued / debited by mistake.

7. Information support of the participant

7.1. By participating in the Program, the Participant agrees to further receive news and other informational and advertising messages from the Organizer on his phone number.

7.2. The Participant can find out about the list of Venues of the Program and about the conditions of special offers, available only for the Participants of the Program, through the Information Center of the Program.

7.3. The Participant has the opportunity to check the amount of Bonuses accumulated on the Account with the help of the Program Information Center, mobile application and cashier's check.

7.4. The Organizer is not responsible for the impossibility of contact with the Participant, if the contact details of the Participant are incorrect or at the time of contact with the Information Center have changed. Participants are personally responsible for the accuracy of the contact information provided by them.

8. Consent to the processing of personal data

8.1. By participating in the Program, each Participant thereby confirms, provides and expresses the following.

8.1.1. The consent of the Organizer of the Program to the processing and use of his personal data provided within the framework of the Program in accordance with these Rules, which does not contradict the legislation of Ukraine.

8.1.2. By participating in the Program, the Participants testify that their approvals / permits, defined in these Rules, are unconditional and appropriate, such that allow to make a conclusion about their provision, within the meaning of Art. 296, 307, 308 of the Civil Code of Ukraine and the Law of Ukraine 'On Personal Data Protection'.

8.1.3. All video and photo materials made with the participation of the Program Participants, created during the Program or in connection with the Program, belong to the Organizer. The Organizer has the right to use the specified materials at its own discretion within the limits provided by these Rules and in accordance with the current legislation of Ukraine.

9. Final provisions

9.1. The Organizer reserves the right to refuse to participate in the Program at its own discretion without any negative consequences for itself.

9.2. The Organizer has the right to unilaterally make changes to these Rules by posting a new version of the Rules on the Program Site.

9.3. Notice of suspension or termination or continuation of the Program, as well as changes to the Rules of the Program is considered sent to the Participant, if it was posted on the Program Site and / or at the Venues and / or sent to the Participant's mobile phone number. In this case, the Organizer is not obliged to notify the Participant of the changes by sending a message to a mobile phone number.

9.4. In case of a situation that allows ambiguous interpretation of these Rules and / or issues not regulated by these Rules, the final decision is made by the Organizer. The decision of the Organizer is final and not subject to appeal.

9.5. The organizer is not responsible in case of force majeure. Such events include: natural disasters, armed conflicts, technical problems, government actions, fires, floods, illegal actions of third parties (theft, damage, and any actions that are violations of current legislation of Ukraine).
